- You own your content. When you leave, we hand over your site's code and content. It's yours to keep.

Who these terms are for
These terms are an agreement between you and FizzPop Media ("FizzPop", "we", "us"), a web design agency located at 7500 Thornapple River Dr SE, Caledonia, MI 49316, USA. They apply to anyone who uses this website, and to every client who subscribes to our services. By using the site or starting a subscription, you agree to them. If you don't agree, please don't use the site or our services.
What we do
FizzPop designs, builds, hosts, and maintains websites for businesses under a monthly subscription. Every plan includes:
- A custom design built for your business, not a template.
- Hosting on our enterprise stack: Git-versioned code served on Cloudflare's edge network.
- Unlimited edits to your existing content, submitted through our visual feedback tool or by email.
- Search engine optimization and ongoing support.
Plans are sized by the number of pages in your site. Adding entirely new sections or pages beyond what your plan covers may mean moving to a larger plan. We'll always tell you before that happens, and you decide.
Getting started and paying
You pay nothing until you approve your free design mockup. Once you approve it, your subscription begins: the one-time setup fee for your plan ($499, $999, or $1,999 depending on site size) and your first month are due at approval, and you are then billed monthly, in advance, on the same day each month. If you commit to 12 months at signup, we waive the setup fee. There is nothing to sign. If you cancel within those 12 months, we ask you to pay the setup fee that was waived, and that is the only consequence. Everything else stays the same: you are billed monthly, you can cancel at any time, and you take your code and content with you.
If a payment fails or is late, we'll let you know and give you a reasonable chance to sort it out. If it stays unpaid after notice, we may suspend hosting until the balance is settled. We'll never take your site down without warning you first.
Prices may change over time. If we change the price of your plan, we'll give you at least 30 days' notice before the new price takes effect.
Cancelling
You can cancel at any time through our contact form, by phone, or by replying to any email from us. Your subscription ends at the close of the current billing period, and you won't be charged again. We don't offer refunds for partial months.
When you cancel, we hand over your website's code and content so you can host it wherever you like. It's yours to keep. Hosting on our stack ends with your subscription, so you'll need to arrange your own hosting from that point.
We may also end the agreement if you break these terms, if your account stays unpaid after notice, or if we stop offering the service. We'll give you reasonable notice and hand over your code and content in the same way.
Your content and responsibilities
You'll need to supply the content for your site: copy, photos, your logo, and anything else you want included. By giving us content, you confirm that you own it or have permission to use it, and you're responsible for making sure it's accurate and legal.
You also agree to:
- Respond to our requests for content, feedback, and approvals in a reasonable time so your project can move forward.
- Submit edit requests through the visual feedback tool we provide, so nothing gets lost.
- Keep your own copies of anything important you send us.
Acceptable use
You may not use our website or a site we host for anything illegal, deceptive, or harmful. That includes distributing malware, sending spam, infringing someone else's rights, publishing defamatory or hateful material, or trying to interfere with our systems or other people's. If we believe a site breaks these rules, we may take it offline while we work it out with you.
Who owns what
Your content is yours. Anything you supply stays your property. You give us permission to use it only to build, host, and maintain your site.
Your site code becomes yours on handover. While you're subscribed, we keep the site in our systems so we can host and maintain it. When the subscription ends, we hand over the code and content, and ownership of that code passes to you.
Our tools stay ours. The internal tools, templates, build systems, and know-how we use to make sites are FizzPop's property and aren't part of the handover. The handover gives you a complete, working website, not our internal toolkit.
Portfolio use. We're proud of our work, so we may show completed sites in our portfolio and marketing. If you'd rather we didn't, just tell us and we'll leave yours out.
Uptime and things we can't control
We build on a reliable stack and work hard to keep your site online, but no one can promise a service will never go down. We don't guarantee uninterrupted or error-free service. Outages caused by our hosting providers, internet infrastructure, or events outside our reasonable control aren't our responsibility, though we'll do what we can to get you back up quickly.
Limits on our liability
To the fullest extent the law allows, FizzPop is not liable for indirect, incidental, or consequential losses, including lost profits, lost data, or lost business, arising from our services or this website. Our total liability to you for any claim is limited to the amount you paid us in the three months before the claim arose. Some jurisdictions don't allow these limits, so they may not fully apply to you.
Apart from what is written in these terms, our services are provided "as is." We don't promise any particular business result, search ranking, or amount of traffic.
Using this website
The content on fizzpopmedia.com, including text, design, and images, belongs to FizzPop or its licensors. You may browse the site and share links to it, but please don't copy or reuse our content without permission. Our Privacy Policy explains how we handle information collected through the site.
Governing law
These terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules. Any dispute that we can't resolve by talking it through will be handled in the state or federal courts located in Michigan, and you agree to that jurisdiction.
Changes to these terms
We may update these terms from time to time. When we do, we'll change the date at the top of this page and, for changes that affect current clients, email you before they take effect. Continuing to use the site or your subscription after a change means you accept the updated terms.
